The example doesn’t make a difference. I’m just making the point that you cannot pick and choose reversals of charges. Drink a beer sing a song make a friend can’t we all get going. It’s not fair to anyone else serving time if a law changed after the fact. If you do it for one law, then you should do it for all laws.

That’s a tough question in my opinion. If I got a ticket for doing 60 MPH in a 50 MPH zone last year; then the speed limit on that road was changed to 60 MPH this year. I wouldn’t expect a reversal of my ticket because I broke a law that was current at that time. Tons of laws are constantly changing, I don’t know if I necessarily feel that anyone law should have exceptions while others don’t. Drink a beer sing a song make a friend can’t we all get going. Agree for the most part – the only thing I will say is that the war on drugs has been such an incredible colossal failure that maybe we should just reverse it all and send everyone home. There just aren’t many policy decisions that you can point at that have had such incredibly horrible consequences.
also, many laws have exceptions even if they have the same level of the charge. For example, Jaywalking and illegal crossing are both 3rd-degree misdemeanors. One is now being locked up and having their families destroyed, the other MAY get a ticket. So reality goes against your view It’s a random example. If you are going to reverse charges because a law changes, then it needs to be that way for all laws; not just law changes that get social media attention.
